The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him passport.

Learned counsel for the petitioner inter alia contends that petitioner applied for passport on 12.10.2022. The respondents have not issued passport because petitioner was implicated in FIR No. 63 dated 12.06.2011, under Sections 364, 323, 325, 148, 149 of IPC and Sections 25 and 27 of Arms Act, 1959. The petitioner was convicted vide judgment dated 18.09.2015 and awarded sentence of 3 ½ years vide order dated 09.10.2015. The petitioner preferred CRA-S-4995-SB of 2015 before this Court. The sentence of the petitioner stands suspended vide order dated 27.01.2016 passed by this Court. The case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391.

Learned counsel for Union of India states that petitioner may be directed to appear before passport authority alongwith requisite documents. On doing so, passport authority would pass an appropriate order considering the afore-mentioned judgment, within six weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In view of statements of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 18.12.2023 alongwith requisite documents.
