Harvinder Singh vs State of Punjab and Others

Tejinder Singh Dhindsa, J.—The Irrigation Department, State of Punjab issued an advertisement in August, 2012 inviting the applications for recruitment for various posts including 25 posts of Junior Engineer (Mechanical). Out of these, 4 posts were reserved for the Backward Class Category. Counsel contends that the petitioner, who belongs to the BC Category, was eligible in the light of the conditions contained in the advertisement and had submitted his application form within the stipulated time frame. In the final merit determined by the respondent-authorities, the name of the petitioner appeared at Serial No. 3 in the order of merit against the BC Category. It has further been submitted that as per merit position, the petitioner was even permitted to participate in the counseling process held on 02.04.2013.

Grievance raised in the present writ petition is that in spite of having produced all the certificates during the process of counseling and having secured the requisite merit position in the selection process, the letter for appointment has not been issued to the petitioner.

Without making any observations as regards the correctness of the averments made in the petition, I deem it appropriate to dispose of the present writ petition with the direction to consider the claim of the petitioner and to take a final decision of his representation dated 15.07.2013 (Annexure P-5) strictly in accordance with law and by passing a speaking order within a period of two months from the date of receipt of a certified copy of this order. Writ petition disposed of.
