The grievance of the petitioner is that the police are not registering the case. Inspite of his lodging a complaint, only D.D.R. has been recorded and Police are not taking any action to investigate into the case saying that it is a civil dispute. Petitioner is a tenant to the shop belonging to Surinder Kaur and that the respondents 3 to 5 went to the shop of the petitioner and thrown away the articles in the cremation ground and also took away some of the articles and it was at about 11.00 p.m. These acts will certainly amount to commission of offence under Sections 379, 380 and 446 of the Indian Penal Code. Though the petitioner is a tenant of the third respondent yet he cannot be evicted by committing such an offence and even whether the offence is committed is a matter of investigation. Therefore, I direct the S.H.O. Police Station Kotwali, Patiala to register a case and issue FIR under relevant Sections of law and take up the investigation.
