The present petition under Article 226 of the Constitution of India is directed against the order dated 23.02.2024 issued by Tehsildar, District Shivpuri and order dated 12.03.2024 issued by the same authority, whereby notice for attachment and proclamation of sale of immovable property of the petitioner under Section 147 of the MPLRC on account of recovery of Rs.80,60,21342/- has been directed.
As an interim measure, the petitioner had sought the stay of the effect and operation of the notice Annexure P/1 and the proclamation Annexure P/2.
Time has been sought on behalf of the State as well as the caveator i.e. respondent no.5 to address upon the issue of interim relief.
Looking to the nature of the controversy and the request made by the counsel for the respondents, this court deems it appropriate to list the matter on 21st of March, 2024 along with WP No.7192/2024, for hearing on the question of interim relief.
I n the meanwhile, the counsel for the State as well as caveator are directed to file their response to the interim relief, if they wish to do so.
