The present Application under Section 482 of the Code of Criminal Procedure, 1973 has been filed by the applicant-accused Harshit Sharma to quash the charge-sheet dated 30.12.2019 and the entire proceedings of Criminal Case No.6549 of 2021, “State of Uttarakhand Vs. Vijendra Singh and Others”, pending before the Court of IInd Judicial Magistrate, Rudrapur, District Udham Singh Nagar.

Subsequent to the submission of the charge-sheet, learned Trial Court took the cognizance against the applicant and co-accused under Sections 323, 504 and Section 506 of the Indian Penal Code, 1860.

Today, before the National Lok Adalat, the applicant-accused Harshit Sharma is present in-person. He is identified by Mr. Suhail Ahmed Siddiqui, Advocate. Informant-injured Vikas Mohan-respondent no.2 is present in-person along with Mr. Ghanshyam Joshi, Advocate.

Mr. Vikas Mohan-respondent no.2 submitted that he has resolved his dispute with the applicant and he does not want to pursue the criminal case against the present applicant.

Both, the applicant and respondent no.2 submitted that they have filed a Compounding Application with affidavits with their free will and without any pressure.

Both the parties submitted that they have filed a Compromise Application today.

The Compromise Application is verified.

Learned counsel for the State has submitted that there were private disputes between the parties and they have resolved their disputes. Therefore, the State has no objection to the Compounding Application.

Keeping in view the totality of the facts and circumstances of the case, this Court is of the view that ends of justice would be met, if the charge-sheet dated 30.12.2019 and the entire proceedings of Criminal Case No.6549 of 2021, pending before the Court of IInd Judicial Magistrate Rudrapur, District Udham Singh Nagar, are quashed, qua the applicant-Harshit Sharma.

Resultantly, the charge-sheet dated 30.12.2019 and the entire proceedings of Criminal Case No.6549 of 2021, pending before the Court of IInd Judicial Magistrate Rudrapur, District Udham Singh Nagar, are quashed, qua the applicant-Harshit Sharma only.

The Criminal Misc. Application (No.775 of 2024), filed under Section 482 of the Code of Criminal Procedure, 1973, is disposed of accordingly.
