This so-called Public Interest Litigation has been preferred with the following prayers:

“A. The respondents may kindly be directed to incorporate and implement a fair and competitive bidding process with equivalent criteria for all

bidders.

B. The respondents may kindly be directed to place before this Hon'ble Court an undertaking to the effect that all norms, guidelines and rules in

respect of the safety of the general public are being adopted for the present work as also for other similar works.

C. The respondents may kindly be directed to incorporate and implement all necessary and/or mandatory guidelines in respect of similar works.

D. The tender may kindly be modified before processing further and awarding the work to any bidder/executing agency.

E. Pass any other order (s) as this Hon'ble court may deem fit and proper in the facts of the case and justice be done.â€​

Having heard the learned counsel appearing for both the sides and looking into the facts and circumstances of the case, it appears that this

petitioner has ventilated the grievances about the manner in which the norms of the construction are being followed by the respondents. We see no

reason to entertain this writ petition mainly for the reason that the construction norms are bound to be followed by the respondents in accordance with

law, rules, regulations and Government policy applicable to the facts of the present case. Moreover, we see no reason to give any guidance to the

respondents regarding change in the construction for the safety norms to be followed by the respondents. We expect from the respondents that the

existing guidelines in this regard shall be strictly followed by them in accordance with law for the construction in question.

With the aforesaid observation, this writ petition is hereby disposed of.

C.M.No.48/2020 (stay)

In view of the final order passed in W.P.(C) 13/2020, this application stands disposed of.
