Judgment
Mahesh Grover, J.—This is a petition u/s 438 Cr.P.C. praying for release of the petitioner on bail in case FIR no. 120 dated 28.9.2012 registered under Sections 323, 324, 326, 427, 452, 148, 149 IPC at P.S. Gharinda, District Amritsar. The allegations as set out in the FIR reveals that certain people came in a car and assaulted the complainant and his relations. The petitioner has been named in the FIR but has been shown not to be carrying any weapon of assault and no specific role has been attributed to him in causing any injury in the incident.
Having regard to the aforesaid, I deem it appropriate to accept the instant petition. Ordered accordingly. It is directed that in the event of arrest petitioner shall be released on bail on furnishing bail bonds to the satisfaction of Arresting/Investigating officer in terms of Section 438 Cr.P.C., subject to the following conditions:-
i) that he shall make himself available for interrogation by a police officer as and when required;
ii) that he shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him for disclosing such facts to the Court or to any police officer;
iii) that he shall not leave India without the previous permission to the Court.
