Petitioner, Harpreet Singh, has filed this petition u/s 439(1) of the Code of Criminal Procedure for grant of regular bail in FIR No. 22 dated 31.1.2010 registered u/s 21 of the ND & PS Act, 1985 and Section 25 of the Arms Act, 1959, in Police Station Sadar Khanna, Police District Khanna, District Ludhiana.

The only accusation against the present petitioner is that one pistol and two live cartridges were recovered from his possession and it has not been disputed by the State Counsel that no such narcotic substance was recovered from his possession and that recovery was effect from the possession of his co-accused. It is not the case of the prosecution that this petitioner was in joint possession of that narcotic substance.

Keeping in view the accusation against the petitioner and without expressing any opinion on the merits of the case, he is ordered to be released on bail to the satisfaction of the Judge, Special Court, Ludhiana, subject to the following conditions:

(i) He shall not offer any threat, promise or inducement to any person acquainted with the facts of the case so as to dissuade him from disclosing the same to the Investigating Officer/Court; and

(ii) He shall not leave the limits of this country without prior permission of the Court.
