Judgment
Learned counsel for the petitioner submits that the petitioner while officiating on the Post of Cashier in The Muktsar Central Cooperative Bank Limited at Sri. Muktsar Sahib was placed under suspension on 21.11.2008 and proceeded against departmentally on the charge of having committed embezzlement of Rs. 32.44/- lacs.
Parallel criminal proceedings were also initiated by virtue of lodging an FIR against the petitioner on 08.09.2011. In the trial that ensued petitioner earned acquittal at the hands of the trial Court. However in the departmental inquiry, findings were returned against the petitioner and which led to the imposition of a major penalty of dismissal.
The petitioner at that stage assailed the order of dismissal before the Joint Registrar concerned and who set aside the major penalty and directed re-instatement on 22.12.2016. The employer then preferred a revision before the Secretary, Department of Cooperation State of Punjab on 22.05.2017 and the same is still pending for consideration.
The precise grievance raised in the instant petition is that respondent No. 1 is not deciding the revision petition preferred by The Muktsar Central Cooperative Bank Limited and on the other hand on account of a status quo order, petitioner has not been permitted to join back on the post inspite of having a reinstatement order in his favour at the hands of the Joint Registrar.
Counsel confines the scope of the instant writ petition for issuance of directions to respondent No. 1 to decide the pending revision petition within a stipulated time frame.
Notice of motion On the asking of the Court Ms. Kanica Sachdeva, AAG, Punjab, who is present in the Court accepts notice and waives service. A complete copy of the paper-book has been furnished to her.
Learned State counsel submits that in case the revision petition bearing No. 15/2017 titled as "The Muktsar Central Cooperative Bank Limited v. Joint Registrar Cooperative Societies Ferozepur" is still pending before the respondent No. 1, the same would be decided expeditiously and in any case within a period of 03 months from today. Statement of learned State counsel is accepted.
In view of the above no further directions are required to be passed.
Writ petition stands disposed of.
It is clarified that this Court has not examined the case on merits.
