The case has been taken up for hearing through video-conferencing.

On 10.09.2020, following order was passed:-

“On the last date of hearing, time was sought by learned counsel for the petitioner to seek instructions if the matter could be amicably

settled. He submits that it is the petitioner’s husband, if at all, who may have been involved in the alleged financial transaction of

accepting money from the complainant with a reciprocal promise of sending her to Canada.

Learned counsel for the petitioner submits that petitioner is sanguine that, if given an opportunity, she would be able to amicably settle the

matter in the interest of her family and in order to avoid unnecessary harassment arising out of the FIR. However, being under constant

apprehension of arrest, she is unable to sit across table with the complainant side to settle the matter. He further submits that petitioner is

otherwise simply a housewife and mother of a four years old child. She has been falsely implicated in the FIR only to put collateral

pressure. In order to test the bona fides of the aforesaid submissions, the petitioner, if required to be arrested, shall be admitted to interim

bail till the next date of hearing, subject to her furnishing bail bonds/surety bonds to the satisfaction of Arresting/Investigating Officer. She

shall abide by the conditions envisaged under Section 438

(2) Cr.P.C. Adjourned to 27.10.2020 to await the outcome of the settlement.

Interim order was ordered to continue on 27.10.2020 also when last opportunity was granted to learned counsel for the petitioner to try out the

possibility of compromise.

Learned counsel for the petitioner submits that the petitioner has not received any intimation from the petitioner as to whether order dated 27.10.2020

has been complied with or not.

He seeks to withdraw this petition with a liberty to file fresh petition in case modalities of compromise are found to have been fully completed.

Dismissed as withdrawn with the liberty aforesaid.
