Judgment
Darshan Singh, J. (Oral) - The present revision petition has been preferred against the order dated 04.02.2016 passed by the learned Additional Civil Judge (Sr. Division), Amritsar, vide which the application moved by the petitioners under Order 6 Rule 17 of the Code of Civil Procedure, 1908 (for short ''CPC'') has been dismissed.
In the application, the petitioners have sought to amend the plaint in order to seek the declaration that they are Class-I legal heirs of respondent no.4.
The petitioners have filed the suit for mandatory injunction directing defendants no.1 to 3 to insert their names being the legal nominee/family member/legal heirs of defendant-respondent no.4 in the form of the family pension under the Family Pension Scheme, 1964.
Learned trial Court has categorically mentioned that defendant no.4 has clearly admitted the relationship of the parties in his written statement. When, there is no dispute with respect to the relationship of the petitioners and defendant no.4. The amendment sought by the petitioners is unnecessary.
Thus, keeping in view my aforesaid discussion, I do not find any illegality in the impugned order passed by the learned trial Court, which does not call for any interference by this Court.
Thus, the present revision petition having no merits, is hereby dismissed.
