The prosecution case is stated to be dependent on the extra judicial confession to Jit Singh. I ascertain the text of extra judicial confession allegedly made before Jit Singh for limited purpose of bail. The statement of Jit Singh indicates that the extra judicial confession was by other accused Puran Singh, who is stated to have confessed that after killing Gian Singh his dead body was thrown in a water canal. Thereafter, dead body was taken out from the canal, a place which was pointed out by the said Puran Singh. It is alleged that the present petitioner Harpal Kaur has conspired with accused Puran Singh because she has developed illicit relation with Puran Singh and wanted to get rid of her husband Gian Singh. On considering the circumstances, I find that this is a fit case in which bail can be granted. Hence, bail granted to the petitioner on her executing bail bond and surety bond to the satisfaction on Chief Judicial Magistrate, Bathinda and on further condition she shall not tamper the witnesses and shall render cooperation in the smooth and speedy trial of the case.
