The present petition filed u/s 439 Cr. P.C. is for grant of bail to the petitioner in case FIR No. 70, dated 26.4.2012, u/s 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985, and u/s 15 of the Indian Medical Council Act, 1956, registered at Police Station Civil Lines, District Bathinda.
I have heard learned counsel for the petitioner and have gone through the whole record carefully, including the impugned order passed by learned Judge, Special Court, Bathinda, vide which application filed on behalf of the petitioner for bail was dismissed.
Brief allegations against petitioner-accused are that he was found in possession of 5 litres of intoxicating solution, 100 grams of intoxicating powder, 180 capsules of Pyrevon spas. On analysis the same were found to be manufactured drugs, which as per the notification come within the definition of commercial quantity.
After arguing for some time, learned counsel for the petitioner requests for withdrawal of this petition. Dismissed as withdrawn.
