Judgment
The present Revision under Section 25 of the Provincial Small Cause Courts Act, 1887 has been filed challenging the order dated 22.02.2023, passed by learned Judge, Small Cause Court/ VIIth Additional District Judge, Dehradun in SCC Suit No.18 of 2019, “Ravi Bangia and Another vs. Harminder Singh and Another”, by which, the opportunity of the revisionists-defendants to cross-examine the respondents- plaintiffs has been closed.
Heard Mr. Siddhartha Sah, learned counsel for the revisionists and Mr. Siddhartha Singh, learned counsel for the respondents.
Mr. Siddhartha Sah, Advocate, has requested to grant the revisionists - defendants only one opportunity to cross-examine the respondents-plaintiffs.
Mr. Siddhartha Singh, Advocate, for the respondents – plaintiffs, has opposed the said request for costs.
Having heard and in the facts and circumstances of this case, learned trial court is directed to give one more opportunity to the revisionists – defendants to cross-examine the respondents – plaintiffs, but on the cost of Rs.10,000.00 (Ten Thousand).
It is made clear that on the date to be fixed by the trial court, the revisionists – defendants shall cross-examine the respondents – plaintiffs. If adjournment is sought by the revisionists – defendants on the said date, the learned trial court would not grant the same and proceed in accordance with law.
With the said directions, the impugned order dated 22.02.2023 is set-aside and the present Revision is disposed of.
