The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent to refund his earnest money of Rs.40,000/-.
The petitioner claims that he participated in the auction for Choice Registration Number. He deposited a sum of Rs.40,000/- as earnest money on 21.06.2025. He was declared successful bidder. He had to deposit balance payment of Rs.2,94,000/-. He deposited said amount, however, respondent due to technical glitch could not accept the said amount. He is entitled to refund of Rs.40,000/-.
Learned State counsel submits that nothing is available on record disclosing whether petitioner participated in the second bid. He is also unaware about right of respondent to forfeit earnest money. Nevertheless, competent authority would consider petitioner’s claim and if he has not participated in the second bid on the basis of aforesaid earnest money or there is no provision of forfeiture of earnest money, earnest money would be refunded within three weeks from today.
In the wake of statement of learned State counsel, the petition stands disposed of.
Pending Misc. application(s), if any, shall also stand disposed of.
