Sabina, J.—Petitioner has filed this petition u/s 439 of the Code of Criminal Procedure for grant of regular bail in case FIR No. 151 dated 7.5.2006 registered under Sections 323, 324, 326, 506, 447, 427, 148, 149 of the Indian Penal Code (`IPC'' for short) at Police Station Sadar Hoshiarpur.

The allegations against the petitioner is that he had given a sword blow on the right thumb of the complainant.

Learned Counsel for the petitioner has submitted that it was a case of cross-version. The other co-accused were already on bail. Now, the petitioner is in custody since 17.1.2009.

Learned Counsel for the State has submitted that the petitioner was declared a proclaimed offender on 1.12.2006 and has surrendered after more than two years.

Keeping in view the fact that it is a case of cross-version and the other accused are on bail and the fact that the petitioner is now in custody since 17.1.2009,without expressing any opinion on the merits of the case, this petition is allowed.

Petitioner be admitted to bail subject to the satisfaction of the Chief Judicial Magistrate, Hoshiarpur.
