Judgment
The present Misc. Appeal is preferred against the order dated
07.09.2013, whereby the application preferred by the appellant
under Section 13 of the Hindu Marriage Act was rejected. During
the pendency of this appeal, the parties have entered into an
agreement and have settled the matter by way of a compromise
deed. The compromise deed has been filed before this Court by
way of an application.
Both the parties are present before the court along with
their counsels.
The application for taking the compromise arrived at
between the parties is allowed, the compromise is taken on
record. The terms of compromise reads as under:- "VERNACULAR MATTER OMITTED"
In view of the compromise entered into both the parties,
the order dated 07.09.2013 rejecting the application of the
appellant under Section 13 of the Hindu Marriage Act is
quashed and set aside. Marriage between the parties is
declared as dissolved in view of the terms of compromise
stated above.
The appeal stands allowed in the above terms.
