The petitioner has assailed the recovery citation dated 06.08.2026 issued by respondent no.2/Tehsildar, Bageshwar, District Bageshwar for recovery of a sum of ₹5,00,000/- (Rupees Five Lakhs) from the petitioner towards the penalty imposed against him under the provisions of the Uttarakhand Minor Mineral Concession Rules, 2023.

Learned counsel for the petitioner submits that the petitioner is ready to deposit the entire outstanding amount, along with up-to-date interest, in installments.

Learned State Counsel has no objection to the aforesaid proposal.

Accordingly, the writ petition is disposed of as follows:

(i)

The petitioner shall deposit a sum of ₹1,00,000/- (Rupees One Lakh only) before respondent no. 3 within a period of two weeks from today.

(ii)

The remaining amount shall be deposited by the petitioner in four equal bi-monthly installments. Along with the last installment, the petitioner shall also deposit the entire accrued interest.

As soon as the entire amount stands deposited, including accrued interest, the recovery proceedings shall stand quashed. However, in case of default in payment, the instant order would be of no avail and it shall be open to the respondents to proceed in accordance with law for recovery of the remaining amount forthwith.
