Judgment
1.This matter is taken up through hybrid mode.
Heard Mr. C. Pattnaik, learned counsel appearing for the appellant and Mr. A.R. Dash, learned Additional Government Advocate appearing for the State-respondents.
The appellant has filed this writ appeal challenging the order dated 29.09.2023 passed in W.P.(C) No.30490 of 2023 under Annexure-9, by which learned Single Judge has disposed of the said writ petition granting 10 days time to the petitioner to join in his service, failing which it shall be open to the authorities to proceed against him in accordance with law.
Mr. C. Pattnaik, learned counsel appearing for the appellant contended that the appellant is suffering from Paralysis due to fracture injuries on his leg, for which he is not able to move. But the learned Single Judge, without taking note of the said fact, passed the impugned order dated 29.09.2023 granting 10 days time to the appellant to join in his service, failing which it shall be open to the authorities to proceed against him in accordance with law. It is further contended that the appellant may be allowed time till 31st of October of this year, so that he will be able to join in his service on 1st November, 2023.
Mr. A.R. Dash, learned Additional Government Advocate appearing for the respondents contended that learned Single Judge has not committed any error while passing the order dated 29. 09.2023 in W.P.(C) No.30490 of 2023 so as to interfere with the same by this Court. Therefore, he seeks for dismissal of this writ appeal.
After advancing some arguments, learned counsel appearing for the appellant contended that the appellant is not challenging the order passed by the learned Single Judge, but seeks for extension of time so that the appellant will be able to join in his service.
In view of the above, this Court modifies the order dated 29. 09.2023 passed by the learned Single Judge in W.P.(C) No.30490 of 2023 by extending the time till 31.10.2023 to enable the appellant to join in his service on 01.11.2023.
Accordingly, the writ appeal stands disposed of.
