Heard.
Counsel for the petitioner submitted that vide order dated 26.2.2003 (Annexure P-1) the petitioner has been transferred from Nagar Palika Nigam, Bhilai to newly constituted Nagar Panchayat, Kharora, District Raipur in the same capacity.
It is submitted on behalf of the petitioner that the petitioner may not be relieved as the academic session is coming to an end and his children are to appear in the forthcoming examinations and the order transferring him to new place may be deferred at least till the end of April, 2003 or else his children will suffer.
It is also submitted that aggrieved therewith, the petitioner has also submitted a representation vide Annexure P/9-A, raising his grievances, but the same has not been considered. The action on the part of the respondents in not considering the representation has compelled the petitioner to approach this Court for relief.
Having heard learned counsel for the petitioner and further having considered the facts and circumstances of the case, it is directed that transfer order dated 26.2.2003 shall not be given effect to till 30th April, 2003. Meanwhile, the Authorities shall consider and decide the representation Annexure P/9-A on its own merits.
With the above observations, the writ petition stands disposed of. Consequently, M.W.P.No.756/2003 and I.A.No.2205/2003 also stand disposed of.
