Judgment
Nirmaljit Kaur, J.—This is a petition u/s 482 Code of Criminal Procedure for issuance of a direction to Respondents No. 2 and 3 to register FIR against Respondents No. 4 to 7 under the appropriate Sections of Indian Penal Code as Respondents No. 4 to 7 have trespassed the house of the Petitioner without any search warrant and without any registration of FIR against the Petitioner or any other family members.
Replies byway of affidavit of DSP, Panchkula as well as Incharge Economics Offence Wing, District SAS Nagar, Mohali have been filed.
Learned Counsel for the Petitioner dispute the contents of reply filed by Incharge Economics Offences Wing, District SAS Nagar, Mohali on behalf of Respondent No. 4. It is also submitted that the Petitioner had filed a representation (P1) to the Superintendent of Police, Panchkula which has not been decided till date.
In view of the above, learned Counsel for the Petitioner states that he would be satisfied if the Superintendent of Police, Panchkula is directed to decide the representation (P1) of the Petitioner.
Accordingly and in view of the above, the present petition is disposed of with a direction to the Superintendent of Police, Panchkula to look into the representation dated 21.04.2010 (P1) and decide the same after hearing the concerned parties within two months from the receipt of a certified copy of the order.
