Affidavit of Sri Arun Kumar Roy, Deputy Municipal Commissioner, Agartala Municipal Corporation, is taken on record.
The petitioners, namely, Sri Hari Narayan Das and Sri Sankar Narayan Das, are also present in the Court.
Undisputedly, on 9th September, 2019, after spot inspection and verification of the land, petitioners' possession over Government land stands taken over. As on date, there is no encroachment by the petitioners. Also petitioners tender an unconditional apology and seek permission to withdraw the
Civil Suit No. 107 of 2016, titled as Sri Hari Narayan Das vs. The State of Tripura & Others, pending in the Court of learned Civil Judge, Senior Division, Court No. 2, Agartala, West Tripura.
Viewing the matter in its totality, this Court is of the considered view that it would be only prudent that the matter is allowed to be closed, as prayed for by acceptence of apology and the Civil Suit be permitted to be withdrawn.
In view of above, the present petition stands disposed of.
The said suit is deemed to have been withdrawn. Registrar (Judicial) is directed to communicate the order dated 6th September, 2019 as also the present order and to be placed on the file of civil suit (Hari Narayan Das supra).
