Judgment
of the advance copy of paper book having already been supplied to her and seeks an accommodation to get necessary instructions as to whether the water course in question can be provided through underground pipe line in terms of the impugned order.
Learned counsel representing the petitioner is directed to handover a copy of the paper book to learned State counsel during the course of day. Adjourned to 28.05.2026.”
Status report by way of affidavit of Subhash Soni, Sub Divisional Canal Officer, Uklana Water Services Sub Division, Saniana has been received. As per the authorities, running of watercourse through underground pipeline is not feasible. The reasoning has been assigned in Para No.9 of the report, which reads as under:
“9.That it is brought to the kind notice of this Hon’ble Court that if the underground pipeline water course is allowed at site, the same would not be feasible for irrigation to the area of the private respondent No.5 as the pipe will have to be laid with depth of 3 feet and 02 hodies will be required to be constructed at site which almost are filled with silt, due to which, the underground pipeline water course is obstructed and the canal water will not pass through the pipeline smoothly. So, the underground pipeline water course in small portion would not be feasible for irrgation to the area of the private respondent No.5.”
In view of the aforesaid report and keeping in view the fact that pure findings of fact have been recorded by the authorities below relying upon the report received from the Field Officer and the compensation has been assessed and ordered to be paid to the petitioner, this Court finds no reason to interfere in the well reasoned orders passed by the authorities below.
Resultantly, finding no merit in the present writ petition, the same is ordered to be dismissed.
