Judgment

Heard learned Advocate Shri Tanmay B. Karia for the applicant and learned APP Ms. Moxa Thakkar for respondents no.1 and 2.
By way of this application under Section 482 of the Code of Criminal Procedure, 1973 ( for short 'Cr.P.C.) the applicant prays for quashment of
Criminal Complaint being C.R. No. 11195035210033 of 2021 registered on 13.01.2021 with Palanpur Taluka Police Station, District: Banaskantha and
all consequential proceedings arising out of the aforesaid FIR for the offences punishable under Sections 363 and 266 of the Indian Penal Code and
Section of 18 of Protection of Children from Sexual Offences Act, 2012 (POCSO).
Learned Advocate Shri Karia submits that the applicant herein has already married the victim whose date of birth is stated to be 25.12.1997.
Considering the same, issue Notice returnable on 16.03.2021.
Learned APP waives service of notice on behalf of respondents no.1 and 2.
Respondent no.3 to be served through concerned Police Station.
Till then interim relief in terms of Paragraph No. 9(C) is granted.
Direct service through E-mail is permitted.
