This petition is directed against the order dated 29.07.2006 passed by the Judge, Family Court, Korba in M.J.C. No. 12/2006.
Parties are the husband and wife. The application u/s 125 of the Code of Criminal Procedure was filed by the Non-applicant against her husband for maintenance. After giving an opportunity of hearing to the parties, the learned Judge, Family Court, Korba has passed the impugned order and awarded of Rs. 1000/- per month to the Non-applicant.
I have heard learned counsel appearing for the parties at length and perused the material available on record.
It is submitted on behalf of the applicant that maintenance are excessive. Para 22 and 23 of the impugned order shows the income of the applicant i.e. Rs. 2288/- and out of Rs.2288/-, Rs.1000/- per month is awarded.
The applicant is liable to maintain his wife and maintenance awarded is not excessive. The Trial Court has not erred in holding the maintenance.
Consequently, the petition is devoid of merit and is liable to be dismissed and it is dismissed.
