Judgment
As per pleadings on record, petitioner was engaged as a Library
Assistant/Restorer on daily wage basis with the Sanmati Govt. Science
Education & Research College, Jagraon on 21.6.2016.
Instant petition has been filed seeking the issuance of a Writ of
Mandamus for directing the respondent authorities to permit the petitioner
to continue on the post in question till such time regular appointments are
not made. Further directions sought are that the petitioner be not replaced
by any other contractual/temporary arrangement.
During the course of arguments, counsel would concede that
the services of the petitioner had been disengaged since March, 2017. No
material has been placed on record wherefrom this Court may infer that the
respondent institute has taken any steps towards engaging a Library
Assistant/Restorer on a contractual/temporary basis.
The instant petition is only founded on an apprehension that the
respondent-institute would resort to a modus of replacing one contractual
employee by another similar contractual arrangement.
Under such circumstances, the prayers raised in the instant
petition cannot be accepted.
Petition, accordingly, is dismissed.
Suffice it to observe that it will be open for the petitioner to
approach this Court afresh at a stage when the respondent institute issues
any advertisement/notice to fill up the post of Library Assistant/Restorer on
a contractual/temporary basis.
