Judgment
Prafulla C. Pant, J.—Heard.
Applicants-Hardeep Singh and Harjeet Singh, who are in jail in connection with Case Crime No. 27 of 2011, F.I.R No. 260 of 2010 relating to offences punishable u/s 364, 325, 323 and 506 of I.P.C., police station Kashipur, District Udham Singh Nagar, have sought their release on bail.
Learned Counsel for the applicants submitted that three persons are said to have been beaten the injured, but No. specific role has been assigned to the applicants. It is further pointed out that Section 364 is added much after the incident and lodging of F.I.R just to give colour of gravity to the offence. It is also pointed out that affidavits have been filed in favour of the applicants by the injured and the complainant.
In the above circumstances, without expressing any opinion as to final merits of the case, this Court is of the view, that applicants deserve bail.
The bail application is allowed. Let the applicants-Hardeep Singh and Harjeet Singh, be released on bail on executing personal bond by each one of them and furnishing two sureties, for each of them, each of the like amount, to the satisfaction of the 3 Chief Judicial Magistrate, Udham Singh Nagar.
