This petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No. 19 dated

30.06.2013, under Sections 498-A and 406 of the IPC at Police Station NRI, District Hoshiarpur.

It is contended by learned counsel for the petitioner that the petitioner has falsely been implicated in this case and his parents have already been

acquitted. In fact, the petitioner was residing in Dubai at the time when the instant FIR was got registered and on return to India, he was arrested. It is

also contended that the petitioner is ready to face the trial.

Mrs. Anju Arora, Addl. A.G., Punjab, has appeared on behalf of respondent-State and contested the bail application. She opposes the grant of regular

bail to the petitioner, however, is not in a position to dispute the fact that parents of the petitioner have been acquitted and the petitioner was a resident

of Dubai at the time of registration of the FIR.

I have heard learned counsel for the parties.

Since the petitioner is in custody since 09.02.2018; his parents have been acquitted and he is ready to face the trial, no useful purpose would be served

in keeping him in custody furthermore. Hence, the present petition is accepted. The petitioner is ordered to be released on regular bail on his furnishing

bail bonds and heavy surety and depositing of his original passport to the satisfaction of the trial Court/Duty Magistrate concerned.

However, any opinion expressed herein is for the purpose of grant of regular bail and not an opinion on the merits of the case.
