Judgment

The petitioner is seeking regular bail in FIR No.178 dated 03.09.2021, under Sections 420, 467, 468, 471, 380, 120-B IPC and Section 65/66 of the Information and Technology Act, registered at Police Station City-2 Khanna, District Ludhiana.
Learned counsel for the petitioner contends that FIR is based on the secret information wherein it is alleged that the accused are stealing ATM data by preparing cloned ATM cards and are thereby duping innocent people. He, however, contends that there is no allegation of any specific person having been duped or any complaint has been filed by any individual against the accused. He further contends that no money was recovered from the petitioner. He is an illiterate person and has been falsely implicated in the case because he was working as a Cook of the co-accused Sachin. He is not involved in any other criminal case. He is in custody for over 03 months.
Learned State counsel states that ATM cards and swipe machine were recovered from the car in which the petitioner was travelling along with co-accused. She further states that matter is under investigation and challan has not been filed.
Heard.
In view of the above, especially when the petitioner is in custody for over 03 months, he is not involved in any other criminal case, Covid 19 pandemic and the conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of regular bail to the petitioner.
Therefore, without expressing any opinion on the merits of the case, the petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
