This is an appeal from a decision of the Subordinate Judge of Bhagulpore, dated the 27th of February 1896. There were two attachments, one in the Subordinate Judge''s Court and the other in the Munsif''s Court, and the process of realization took place under sec. 285 in the Superior Court. The person whose decree was executed in the inferior Court applied for rateable distribution, but he did not get his decree transferred. Sec. 295 does not require the transfer of a decree as a condition precedent to an application under sec. 285. We think, therefore, that the decree of the lower Court is right, and we dismiss the appeal with costs.
