Judgment
This petition has been filed under Section 482 of BNSS, 2023 (earlier Section 438 Cr.P.C.), for grant of anticipatory bail to the petitioners, who have been booked in a criminal case arising out of First Information Report, as detailed hereunder:-

FIR in the instant case was got registered at the instance of complainant-Amritpal Singh with the following allegations:-
"xxx that he is labourer by profession and 8th pass and knows Punjabi language. His father had expired about 8 years ago. They are five brother and sisters and all his sisters are married. He is bachelor and residing with his mother. His sister Ramandeep Kaur wife of Jagsir Singh along with her son Karandeep Singh came to their house. On 09.05.2025, he along with his mother Paramjit Kaur, sister Ramandeep Kaur and nephew Karandeep Singh, after taking meals were sleeping in the verandah. At about 10:30 p.m. Bhola Singh, resident of Sardulgarh knocked at the gate of the complainant and got it open. Thereafter, Gurpreet Singh alias Kaddi, Rajwinder Singh alias Kala sons of Mithu Singh, resident of Dulowal raised a Lalkara not to leave him. They along with Bhola Singh, resident of Sardulgarh, Ranjit Singh alias Ghona son of Raj Singh and 4 other unidentified persons along with weapons entered their house. Gurpreet Singh alias Kaddi inflicted a Kirpan blow above his forehead on his head and thereafter, Rajwinder Singh alias Kala inflicted a Gandasa blow on left side of his head. Thereafter, Ranjit Singh alias Ghona inflicted a Kirpan blow on the left side of his head and to ward off the same, he raised his left hand and due to which, all the four fingers of his left hand were cut. Thereafter, Bhola Singh inflicted a blow of iron pipe fitted gearari of motorcycle on his left shoulder and he fell down on the ground.
Thereafter, aforementioned case was registered against the accused persons namely, i) Gurpreet Singh @ Kaadi, ii) Rajwinder Singh @ Kala, iii) Ranjit Singh, iv) petitioner No.1-Happy Singh @ Bhola and v) petitioner No.2-Ranjit Singh @ Ghona and four unknown persons, who trespassed the house of the complainant and then caused injuries to him with sharp edged weapons.
Incident in question took place inside the house of the complainant at about 10.30 pm on 09.05.2025, when complainant alongwith his mother Paramjeet Kaur, Sister Ramandeep Kaur and nephew Karandeep Singh were sleeping in the Varanda after taking meal;
Accused Gurpreet Singh @ Kaadi gave a kirpan blow above forehead (on the head) of injured-Amritpal Singh.
Rajwinder Singh @ Kala gave gandassa blow on left side of the head of Amritpal Singh, Ranjit Singh @ Ghona (petitioner No.2) gave a kirpan blow on left side of the head, however, same was warded of by injured Amritpal Singh by raising his left hand, resulting into the cutting of four fingers of the left hand.
Accused Bhola Singh gave iron pipe fitted gerari of motorcycle on the left shoulder of Amritpal Singh, due to which he fell down on the ground.
Injury No.1 and 3 were declared as grievous in nature.
Without addressing much, counsel relies upon the compromise deed dated 14.05.2023 (P-3) having been executed by members of both the parties i.e. four of the named accused on one side as first party and injured-Amritpal Singh along with other two family members
Four unknown persons as said in FIR are not the party to the compromise.
Counsel for the petitioners also argues that on the basis of said compromised one quashing petition under Section 528 of BNSS i.e. CRM-M-31507-2026 is already instituted in which vide order dated 28.05.2026 (P-2) while issuing notice direction has been issued for recording of the statements of the parties on the issue of already executed compromise.
In view of the above, this is not a fit case for grant of pre arrest bail to the petitioners and the petition is dismissed.
Pending application(s), if any, also stand disposed of accordingly.
