Judgment
Kumar, J.—This petition is filed complaining of disobedience of the order dated 15.11.2010 passed in W.P.No.19073/2009.
The direction issued is to consider the case of the petitioner for the post of Grama Sahayaka along with other candidates and also that of respondent No.2 and thereafter, respondent No.1 is at liberty to make selection in accordance with criteria laid down in Annexure-A.
After service of notice, the respondents have entered appearance and a counter affidavit is filed by the Tahsildar, Honnalli Taluk, Davanagere along with annexures, which shows that a notification has been issued calling for applications for the post of Grama Sahayaka. It is stated in the counter affidavit that the case of the petitioner, as per the direction of the Court, would be considered along with other candidates, As the respondents have taken steps, there is no contempt. The proceedings are dropped.
It is made clear that the respondents shall consider the application already filed by the petitioner without insisting an any fresh application in pursuance of the fresh notification issued.
Learned Government Advocate is permitted to file memo of appearance within four weeks.
