We have heard the learned counsel appearing for the appellant - complainant and the learned counsel appearing for the State of Rajasthan and Respondent No. 2 - accused at length.

It appears that after the anticipatory bail was granted by the High Court to the accused - Respondent No. 2 herein, he is not cooperating with the investigating officer which is evident from the affidavit filed on behalf of the State of Rajasthan. It is mentioned in the affidavit that the concerned Sub Inspector went to the office of the accused on 8-12-2014 but he could not be found there and thereafter the accused as well as his counsel was contacted on their mobile numbers whereupon it was found that he is out of Jaipur. These facts establish that the accused is not cooperating with the investigating officer.

In view of the above, it is necessary for us to set aside the impugned order of the High Court granting anticipatory bail to the accused - Respondent No. 2.

Accordingly, we set aside the impugned order of the High Court granting anticipatory bail to the accused - Respondent No. 2 and as a consequence thereof direct the investigating officer to take appropriate steps in the matter.

The appeal is allowed in the afore-stated terms.
