The accused/applicant seeks anticipatory bail in case FIR No. 687/2025 of PS IGI Airport, Delhi for offence under Section 318(4)/336(3)/340(2) of BNS and Section 12 of Passport Act.

I have heard learned counsel for accused/applicant and learned APP for State assisted by IO/SI Manoj Kumar.

The IO has not brought investigation file but is able to brief learned APP. There appears to be no serious objection to this anticipatory bail application, as there is no cogent incriminating evidence against the accused/applicant.

Broadly speaking, the prosecution case is that one Wasim Khan was deported from Hong Kong on the basis of some discrepancy in his passport which arose on account of difference of years of birth in the Aadhar Cards of Wasim Khan. In his confessional statement, Wasim Khan alleged that the present accused/applicant, being operator of the documentation centre, had facilitated in obtaining the second Aadhar Card. It is categorically stated by the IO that date, month and year of birth in the second Aadhar Card is same as on the portal of the concerned authorities.

Under these circumstances, the present application is allowed and it is directed that in the event of his arrest, the accused/applicant shall be released on bail, subject to his furnishing a personal bond in the sum of Rs. 10,000/-with one surety in the like amount to the satisfaction of the IO/SHO concerned and also subject to the accused/applicant joining investigation as and when directed by the IO in writing. Pending applications stand disposed of.
