Judgment
Hon''ble Rajesh Dayal Khare, J.—List revised. Sri Manoj Kumar Misra, learned counsel for the applicants is present. However, Sri Sulabh Kumar Srivastava, learned counsel for the private opposite party is not present.
Heard learned counsel for the applicants and learned A.G.A. for the State.
Learned counsel for the applicants contends that after submission of final report, on the protest petition the matter was treated as a complainant case and after recording of the statement of Shabbit Ali as an eye witness, the applicants have been summoned. It is further contended that although statement of Shabbir Ali was recorded but the same has been signed by Ilyas, which shows that the statement of imposter has been recorded and pursuant to his statement, the applicants have been summoned.
Learned A.G.A. prays for further time to file counter affidavit.
Accordingly, three weeks'' time is granted to learned A.G.A. to file counter affidavit. Sri Sulabh Kumar Srivastava, learned counsel for the private opposite party may also file counter affidavit within the same period. Learned counsel for the applicants may file rejoinder affidavit within two weeks'' thereafter.

Learned counsel for the applicants undertakes to inform Sri Sulabh Kumar Srivastava, learned counsel for the private opposite party about the order passed today. Interim order, if any, granted earlier shall remain operative till the next date of listing.
