Judgment
This is the successive application for bail filed by the accused in Crime No.5 of 2020 of Nilambur Excise Circle Office, Malappuram, for having
allegedly committed offences punishable under Sections 8(c), 20(b) (ii) C, 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, for
short (the “NDPS Actâ€). The prosecution case, in brief, is this:
On 20.05.2020 at about 12.35 AM, while the applicant was travelling in a lorry bearing Reg No. KL-58Q-7386 driven by the 1st accused. They
were apprehended by the Excise party and 58.500 Kgs of ganja was seen concealed inside the lorry and the applicant was remanded to judicial
custody. The earlier application filed by the applicant for bail as B.A.No.5137 of 2020 was rejected by this Court in view of the commercial quantity
of ganja involved and the embargo under Section 37 of the NDPS Act. There was also sufficient material indicating the complicity of the applicant and
hence, there was no reason to believe that the applicant could be not guilty. There are no change of circumstances pointed out by the learned counsel
appearing for the applicant. And, hence, I find no reason to entertain the application of the applicant for bail again.
The application is therefore, dismissed.
