Judgment
S. Abdul Nazeer, J.—The subject, matter of this writ, petition is the land bearing Sy. No. 35/5 measuring 1 acre situated Janthagalli village, Varuna Hobli, Mysore Taluk and District. The owners of the said land namely Sri. Basavegowda, Smt. Kalamma, B. Chandra and B. Mahalakshmi have executed an agreement of sale dated 4.3.2008 in favour of the Petitioner. The said agreement was registered on the same day as document No. MYN-1-17377/2007-08 in the office of the Senior Sub Registrar, Mysore (North). The Petitioner made an application to the 1st Respondent for entering his name in. column No. 11 of the RTC pertaining to the said land The Assistant Commissioner, Sub Division, Mysore, by communication dated 25.11.23009 (Arnnexure-C) has also directed the 1st Respondent to take steps for entering name of the Petitioner in the RTC in accordance with law. The 1st Respondent issued an endorsement as per Annexure-D dated 9.6.2010 rejecting the application of the Petitioner on the ground that his name cannot be recorded in the RTC as there is a technical limitation in the software. The Petitioner has challenged the said endorsement in this writ petition.
I have heard learned Counsel for the parties.
It is clear that the owners of the aforesaid land have executed an agreement of sale dated 4.3.2008 as per Annexure-A in favour of the Petitioner. The said agreement has been registered in the office of the jurisdictional Sub Registrar. When a document is registered, there is no reason why the 1st Respondent should not make a suitable entry in the RTC of the, land in question. Therefore, 1 direct the 1st Respondent to make suitable entry in column No. 11 of the RTC relating to the land in question, within a period of four weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
