Judgment
This writ appeal is directed against the judgment and order dated October 20, 2016, passed by the Hon''ble Single Judge.
The writ appeal is barred by limitation. The delay is of 86 (eighty six) days. Since the matter concerns appointment of a person to the post of First Division Assistant in the PES College of Engineering, Mandya, we take up the writ appeal for consideration on merits.
The respondent No.5 in the writ petition was selected to the post of First Division Assistant although he secured 80.96% per centum whereas the writ petitioner secured 85.46% per centum in the selection process.
Therefore, the Hon''ble Single Judge, in our view, rightly, set aside the order of appointment in favour of the respondent No.5 and directed the authorities to consider appointment of the writ petitioner to the post of First Division Assistant, if he satisfied all other eligibility criteria.
We do not find any merit in the writ appeal.
Therefore, the application for condonation of delay in filing the writ appeal is dismissed. Consequently, the writ appeal is dismissed.
In view of the dismissal of the writ appeal, I.A.No.II of 2017 does not survive for consideration and is, also, dismissed.
We make no order as to costs.
