Heard the parties.
To save the matrimonial home, the applicant-husband has been granted provisional bail vide order dated 06.06.2023 in connection with Complaint Case No. 1057 of 2021.
It appears that after granting provisional bail, nothing has been brought on the record to suggest that any positive attempt has been taken by the applicant for conciliation of the matter in between the parties.
Learned A.P.P. has submitted that even after solemnizing marriage in a Temple, she has been driven out from the matrimonial home.
Considering the above facts, provisional bail granted to the applicant vide order dated 06.06.2023 is hereby, cancelled.
This anticipatory bail application stands rejected.
The applicant is directed to surrender before the court below within two weeks from today and if the applicant is not surrendered within the stipulated period, the court below is directed to take all coercive steps for taking the applicant/petitioner to judicial custody.
However, if the applicant(s) surrenders and pray(s) for regular bail, the same be disposed of, without being prejudiced by the order of this Court.
