Earlier, CWP No.25841 of 2019 titled 'Gurvinder Singh vs State of Punjab and others' was filed in the High Court which was dismissed by the Division Bench on 17.09.2019 by observing that the first appeal filed by the petitioner has since been decided on 16.09.2019, therefore, petition was held to be infructuous on 17.09.2019.

Vide order dated 16.09.2019 passed by Director, Food, Civil Supplies and Consumer Affairs Department, Chandigarh, Punjab, the first appellate authority as per Clause 17 of the Policy directed respondent No.3 to re-evaluate the technical bid of the petitioner in view of facts and circumstances of the case.

Against the said order, respondent No.4 has also preferred an appeal before the Principal Secretary, Food, Civil Supplies and Consumer Affairs Department, Chandigarh, Punjab and the same is fixed for 17.10.2019.

Re-evaluation process as per the order dated 16.09.2019 is fixed for 10.10.2019 before the competent authority.

In view of aforesaid factual position, this writ petition is disposed of by directing respondent No.3 to finalize the process of re-evaluation in accordance with law either on the date fixed i.e. 10.10.2019 or 07 days thereafter without being influenced by any statement of facts recorded hereinabove.

Respondent No.4 would be at liberty to avail his legal remedies in pending appeal before the Principal Secretary, Food, Civil Supplies and Consumer Affairs Department, Chandigarh, Punjab.
