Gurwinder Singh vs State of Punjab and Another

Mahesh Grover, J.—This is a petition u/s 482 Cr. P.C. praying for quashing of FIR No. 42 dated 19.8.2011 u/s 498-A IPC, registered at Police Station, Women Cell, Jalandhar, on the basis of compromise. On 14.2.2013, this court had directed the trial court to record the statement of all the affected persons and further record a finding as to whether the compromise has been effected voluntarily by the parties.

That report has since been received alongwith copies of the statements of the affected persons which also indicates that the matter has been resolved amicably between the parties without any pressure from any quarter. Having regard to the aforesaid and the observations made by Full Bench in Kulwinder Singh and Others Vs. State of Punjab and Another, and of Hon''ble Supreme Court in Gian Singh Vs. State of Punjab and Another, , instant petition is accepted. Consequently, FIR No. 42 dated 19.8.2011 u/s 498-A IPC, registered at Police Station, Women Cell, Jalandhar and all consequent proceedings arising therefrom are hereby quashed.
