Petitioner Gurvinder Kaur filed present contempt petition under Article 215 of the Constitution of India read with Section 10 & 12 of the Contempt of Courts Act for violating order dated 07.04.2026 (Annexure P-1) passed in CWP-7504-2026.

In CWP-7504-2026, on dated 07.04.2026 the State counsel had appeared and produced memo dated 25.03.2026 vide which the impugned suspension order was withdrawn and petitioner was re-instated in service vide order dated 20.03.2026. It was further stated that she has been charge-sheeted vide memo dated 25.02.2026. It was further explained that there was delay in issuing charge-sheet as the post of Head of the Department was lying vacant and without his approval, the charge-sheet could not have been issued.

In view of the aforesaid factual position, the civil writ petition was disposed of with the observation that nothing survived for adjudication as the impugned order of suspension was withdrawn.

Learned counsel for petitioner filed present contempt petition on the sole ground that after the withdrawal of impugned suspension order, instead of posting her to Mool Chand Govt. I.T.I Ambala Cantt., the petitioner has been transferred to Industrial Training Institute, Brara at Holy. It is pointed out that respondent was bound to take back the petitioner to the same place from where she was suspended.

On the other hand, learned counsel representing respondents filed compliance report along with the order dated 20.03.2026 (Annexure R-1) vide which the petitioner was re-instated and during the pendency of inquiry was posted to Government Industrial Training Institute, Brara at Holy. The order dated 28.03.2026 is Annexure R-2. It is further pointed out that there is no violation to the order dated 07.04.2026. The civil writ petition was disposed of and as such no specific direction was given by the Court.

I have considered the aforesaid factual position, the present contempt petition is filed only on the sole ground that the petitioner has been transferred to Government Industrial Training Institute Brara at Holy instead of Mool Chand, Government I.T.I., Ambala Cantt. The perusal of order dated 07.04.2026 (Annexure P-1) shows that there were no specific directions with regards to her posting at a particular place otherwise the suspension order was withdrawn and the charge-sheet is already issued and posting order has been issued.

In the light of this, I do not find any willful disobedience to the order dated 07.04.2026 passed in CWP-7504-2026, no action is required in the present contempt petition and the same is accordingly disposed of.
