Guru Ravi Dass Trust and Another vs State of H.P. and Others

Kurian Joseph, C.J.—The writ petition is filed with the following prayers:

(i) That the Ld. Civil Judge (Senior Division), Nurpur district Kangra may kindly be directed to decide the civil Suit No. 22/2002 at the earliest and the Ld. Divisional Commissioner Kangra at Dharmshala may also be directed to decide the appeal pending before him at the earliest so that the title and ownership of the land in question is determined and thereafter;

(ii) The Respondents No. 1 & 2 may kindly be directed to consider the case of the Petitioner trust for grant of land on lease, comprised in Khasra No. 97/3, measuring 1-93-60 hectares of land, situated in Village Bhadroya, Tehsil Nurpur, distt. Kangra, H.P., strictly inconformity with the Himachal Pradesh lease Rules, 1993

In the nature of order, we propose to pass in this case, it is

There will be a direction to the Civil Judge (Senior Division) necessary to refer the factual position in detail. Nurpur, District Kangra to expedite the trial of Civil Suit No. 22 of 2002 and dispose of the same within two months from the date of production of copy of this judgment by the Petitioners before the Court of Civil Judge (Senior Division) Nurpur. The Divisional Commissioner, Kangra at Dharmshala will dispose of the appeal pending before him within another one month. Thereafter, the first Respondent will address the issue on the request of the Petitioner for lease within another three months. Needless to say that the second Respondent will do the process work within six weeks. The Petitioner will produce the copy of this judgment alongwith copy of writ petition before the Civil Judge (Senior Division) Nurpur, District Kangra, Divisional Commissioner, Kangra and Deputy Commissioner, Kangra at Dharmshala.

With these observations, the writ petition stands disposed of, so also the pending application(s), if any.
