TRIBHUVAN DAHIYA, J. (ORAL)
The petition has been filed, inter alia, seeking a direction to prohibit respondent no.5 - Scheduled Caste/Scheduled Tribe Commission, Punjab, from proceeding with and deciding the complaint, dated 17.12.2025, Annexure P-9, filed by respondents no.7 to 12 to the Station House Officer, Police Station Banur.
Learned counsel contended that the aforementioned complaint could not have been taken up for decision by the Commission, as the matter in issue is already pending adjudication before the Civil Court in civil suit no.16 of 2026, filed by some of the petitioners seeking permanent injunction against the defendants (respondents no.7 to 12 herein) and their agents from interfering with the peaceful use of the suit land, before the Civil Judge (Junior Division), SAS Nagar, Mohali, and an interim order dated 06.01.2026, Annexure P-5, has also been passed therein.
It is apparent on record that the complaint in question has been filed seeking necessary action against the concerned individuals for uprooting and desecrating the statue of Baba Sahib Dr. Bhimrao Ambedkar installed on 03 bighas of land belonging to the Gurudwara Sahib. Thereupon, the Commission passed the following order, dated 15.01.2026, Annexure P-10:
Sh. Deep Singh & other persons of his brotherhood all r/o Village: Kalauli, PS: Banur, District: SAS Nagar, have approached the Punjab State Schedule Caste Commission through the complaint received on dated: 17/12/2025. The commission has decided to enquire into the complaint in view of the powers granted under section 10 of the Punjab State Schedule Caste Commission Act, 2004. The commission wants the following: -
1.Who was the owner where the idol Babasaheb Dr Bhimrao Ambedkar was installed?
2.The Tehsildar, Banur, shall personally appear before the commission office and shall submit the revenue record, mutation & complete record of the previous 25 years regarding the ownership of the land as claimed by Gurpreet Singh son of Surinder Singh?
2.In case the compliance of the above is not carried out, the commission will invoke its powers under section 10 (1) of the commission Act, 2004, as that of the civil Court.
Apparently, vide the aforementioned order the Commission has sought certain information from the Deputy Commissioner regarding the statue of Dr. Bhimrao Ambedkar and ownership of land claimed by Gurpreet Singh. Seeking information does not in any manner indicate that the Commission has interfered with the matter on merits, which is already sub-judice before the Civil Court. Also, it has not been shown that the Commission is restrained from seeking such information under any provision of law.
In this view of the matter, there is no ground to entertain the petition at this stage and it is hereby dismissed.
