Learned counsel for the petitioner contends that against the judgment and decree dated 23.11.2016 passed by Civil Judge (Junior Division), Kurukshetra, an appeal was filed before the lower Appellate Court along with an application for ad interim injunction. An application under Order 44 CPC was also filed along with the appeal for permission to file the appeal as an indigent person.
A report was summoned from the Collector, Kurukshetra. As per the report, the appellant has no movable or immovable property in his name.
Grievance of the petitioner is that despite receiving the aforesaid report of the Collector, his application for ad interim injunction during pendency of the appeal has not been decided by the Additional District Judge, Kurukshetra, rather the appeal has been adjourned to 04.12.2019 for arguments.
The Additional District Judge, Kurukshetra is directed to take up the pending application for ad interim injunction within three weeks from today by preponing the date of hearing of the appeal after due notice to learned counsel for the respondent.
Till such time, status quo regarding possession over the suit property be maintained.
Disposed of.
