This application is filed for placing on record the replication to the written statement filed by respondent No.4 along with document Annexure P-11.

The petitioner has prayed for the issuance of a writ in the nature of certiorari for quashing the impugned order dated 21.6.2017 by which the prayer

made by the petitioner for grant of tubewell connection has been declined on the ground of a pending civil litigation between the petitioner and his

brother/respondent No.4.

Learned counsel for the petitioner has placed on record the decision of the civil Court as Annexure P-11 dated 6.12.2017 to show that the suit filed

by his brother Gurtej Singh/respondent No.4 in regard to the partition of tubewell has been dismissed.

In view thereof, learned counsel for the respondents has submitted that since the pending civil litigation is over, therefore, there is no hindrance in the

way of the respondents in granting the tubewell connection.

In view thereof, the present petition is allowed and the impugned order dated 21.6.2017 is set aside. Direction is issued to respondent No.2 to issue

the tubewell connection to the petitioner at the earliest, preferably within a period of 15 days, from the date of receipt of certified copy of this order.
