Heard through video conferencing.

The petitioner is seeking anticipatory bail in FIR No.711 dated 12.11.2020, under Sections 323, 365, 511, 34 and 506 IPC, registered at Police Station

Assandh, District Karnal.

Learned counsel for the petitioner contends that it is alleged that the petitioner had tried to abduct the complainant from the Court premises. He,

however, contends that the petitioner had come to the Court premises in connection with civil suit bearing No.691 of 2020 which involved a dispute

between her and her in-laws after the demise of her husband. Co-accused, Ankit had also come to help her and the complainant, namely, Ritu Rani is

the wife of Ankit. There is a matrimonial dispute between the two. He further contends that no case of Ritu Rani had been listed before the trial Court

on the date of occurrence and therefore, there was no occasion for her to come to the Court. He also contends that the allegations are that the

petitioner and co-accused had entered into scuffle with Ritu Rani and others. He has referred to the copy of the reply filed by the Deputy

Superintendent of Police, Assandh wherein it is stated that the parties had entered into scuffle. He also contends that the parties were unarmed and no

injury was caused to anyone, as there is no MLR.

This Court, by the order dated 05.01.2021, had directed the petitioner to appear before the Investigating Officer and join the investigation and in the

event of her arrest, she was to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions

envisaged under Section 438(2) Cr.P.C.

Learned State counsel contends that although the petitioner has joined the investigation but the vehicle, on which the accused had come, is yet to be

recovered.

In view of the above and the petitioner having joined investigation, the order dated 05.01.2021 granting interim bail to the petitioner is made absolute.

However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon

to do so.

The petition stands disposed of.
