Judgment
Satish Kumar Mittal, J.—Petitioner Gurdev Singh has filed this petition u/s 439 of the Code of Criminal Procedure for the grant of regular bail in case FIR No. 18 dated 16.2.2002 under Sections 406/498-A/34 IPC, registered at Police Station Ismailabad, District Kurukshetra.
I have heard the arguments of counsel for the parties and gone through the contents of the FIR as well as the order dated 3.11.2006, passed by Sessions Judge, Kurukshetra, whereby bail application of the Petitioner has been dismissed.
In this case, the Petitioner, who is husband of the complainant, was arrested on 16.10.2006. Counsel for the Petitioner contends that till date, only one prosecution witness has been examined, out of seven witnesses and trial is not likely to conclude soon.
In view of the above, without expressing any opinion on the merits of the case, I deem it appropriate to grant regular bail to the Petitioner and he is, accordingly, ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of the trial court.
