Learned counsel for the appellant submits that although the correct name of the respondent is 'Taru Buildcon Private Limited', the name was incorrectly mentioned as 'Taru Buildhome Private Limited' in the agreement to sale and the sale deed from the beginning. This mistake continued till the filing of the civil suit, resulting in recording incorrect name of respondent.
It has also been pointed out that during the settlement discussions between the parties, one of the conditions of the settlement was that the documents regarding the conveyance of the property are also to be redrawn to reflect the correct name of the respondent.
Heard on I.A. No.726 of 2026, an application filed under Order VI Rule 17 of the Code of Civil Procedure, 1908 for amendment of the appeal memo.
Learned counsel for the appellant submits that due to oversight, the name of the respondent has been mentioned incorrectly in the cause title.
On due consideration, the submission of the appellant is found to be correct. Accordingly, the application is allowed and the appellant is permitted to correct the cause title in terms of para 6 of the application.
Let necessary correction be carried out during the course of the day. Also heard on I.A. No.725 of 2026, an application under Order XXIII Rule 3 read with Section 151 of the CPC for disposal of this appeal in view of the settlement reached between the parties.
The parties have arrived at an amicable settlement in the terms mentioned in para 2 of the applicant. Both learned counsel for the parties submit that the parties are available in Court today. Accordingly, they are directed to remain present before the Registrar of this Bench Registry after lunch to record their statements regarding the settlement.
List the matter on 21.01.2026 for further consideration after recording of statement before the Registrar.
