Reply to CM No.14470-CWP of 2016 has been filed in Court

today, which is taken on record. Copy supplied to Mr. Arora.

Having regard to the contents of the circular dated 01.12.2016

(Annex R-1), attached with the reply to the application, this petition can be

disposed of on the undertaking given in Para.5 of the application by the

constituted attorney for the Bank of India that the claim of the petitioner will

be considered in terms of the Head Office''s circular dated 01.12.2016 on

receipt of his application.

In view of this turn of events, this petition has been rendered

infructuous. The benefit of privileged leave encashment has been made

available to the petitioner and will be regulated in the manner provided in

the decision of the Board in its meeting held on 03.11.2016 as reflected in

Annex R-1.

In case, the petitioner has any other grievance with respect to

implementation of the benefit, which is not foreseen in Court today, he may

raise the issue with the Bank and they would look into the matter and take a

decision thereon in accordance with law. Needless to say, the Bank would

honour its commitment and handover the monetary value of the concession

to the petitioner within a period of two months of the date of receipt of

application from the petitioner. The Bank will also consider; whether there

are any prevailing regulations governing payment of interest on delayed

payment of money which, if available can be awarded on this account.

With these observations, the application as well as the main

writ petition stand disposed of.
